LAXOR, INC. (LAXOR®, LAXOR) IS NOT A HEALTH CARE PROVIDER AND DOES NOT PROVIDE ANY HEALTH CARE SERVICES, INCLUDING DIAGNOSIS, TREATMENT OR ADVICE. FURTHERMORE, LAXOR, INC. MAKES NO WARRANTY OR REPRESENTATION REGARDING THE CONTENT OF ANY INFORMATION STORED IN ANY AND ALL LAXOR® MEMBERS’ PERSONAL HEALTH RECORDS.
ANY USE OF THE LAXOR PUBLIC WEBSITE OR THE LAXOR PERSONAL HEALTH RECORD INDICATES THAT YOU HAVE READ, ACCEPT, AND AGREE TO ABIDE BY THESE TERMS OF USE.
WHILE LAXOR ENDEAVORS TO ENSURE THAT YOUR LAXOR PERSONAL HEALTH RECORD IS ALWAYS AVAILABLE, LAXOR MAKES NO REPRESENTATION OR WARRANTY AS TO THE ACTUAL AVAILABILITY OF YOUR LAXOR PERSONAL HEALTH RECORD, AND THEREFORE, LAXOR INC. ACCEPTS NO LIABILITY FOR THE INABILITY OF ANY PERSON, PERSONS, ENTITY OR ENTITIES TO ACCESS YOUR LAXOR PERSONAL HEALTH RECORD AT ANY TIME.
FURTHERMORE, LAXOR MAKES NO REPRESENTATION OR WARRANTY AS TO THE PROFESSIONAL STANDING OF ANY PERSON, PERSONS, ENTITY OR ENTITIES TO WHOM YOU HAVE ELECTED TO GRANT ACCESS TO YOUR LAXOR PERSONAL HEALTH RECORD. THEREFORE LAXOR IS NOT RESPOSIBLE IN ANY CAPACITY FOR ANY AND ALL SUCH ACCESS, AND ANY AND ALL USAGE BASED ON SUCH ACCESS OF ANY AND ALL HEALTH INFORMATION AND RELATED DOCUMENTS STORED IN YOUR LAXOR PERSONAL HEALTH RECORD.
RESTRICTED ACCESS
The LAXOR PERSONAL HEALTH RECORD (PHR) is a restricted-access, private, subscription-based, online patient (Member)-centric health record. Fraudulent use, including but not limited to fraudulent access, will be prosecuted to the full extent allowed by law.
CHANGES TO THESE TERMS OF USE
LAXOR reserves the right to modify these Terms of Use at any time in the future.
Any changes to these terms and conditions will be posted on the LAXOR public website, within the PHR, and you will also be notified via a generalized broadcast message.
DEFINITIONS
- LAXOR, Inc. is the developer and owner of the LAXOR Personal Health Record, and is abbreviated LAXOR® or LAXOR.
- LAXOR Personal Health Record means the limited access online patient (Member)-centric health record, and is abbreviated PHR.
- Member means an individual health care consumer and/or his or her legal designee who is currently in good standing with LAXOR.
Limited Right to Use
The PHR is a restricted access, private, subscription-based, online Personal Health Record. It is to be used strictly for purposes of storing, and accessing documents and information related to LAXOR’s Members’ health, and the management of related information and documents.
Members and anyone else posting (uploading) health information into a Member’s PHR agree to endeavor to ensure to the best of his or her ability that the health information is derived from legitimate sources and is accurate. Nevertheless, LAXOR makes no representation or guarantee as to the accuracy, legitimacy or validity of any and all sources of any and all information stored in any and all LAXOR Personal Health Records.
RESTRICTED ACTIVITIES
You agree not to access another Member’s PHR using false identification or names.
You agree not to post (upload) false or illegal information into your PHR or any other Member’s PHR.
You agree not to use the PHR to engage in any illegal or fraudulent activities or to use defamatory or obscene language, or obscene graphics (images).
LAXOR reserves the right to immediately terminate the membership and use of the PHR of any person or persons engaged in any activity that contravenes the provisions of this section. Such termination is called “termination for cause”.
LAXOR reserves the right to seek civil redress from you in any court of competent jurisdiction for any activities on your part that contravene the provisions of this section.
LAXOR reserves the right to seek criminal charges against you for any activities on your part that contravene the provisions of this section.
ACCESS
The PHR has built-in capability for you to grant access to others to allow access to your health information. If you have elected to grant access to others, LAXOR makes no guarantee regarding the professional standing of anyone to whom you have granted such access.
AGE of USE
All users of the PHR must be at least 18 years of age or older. By using the PHR you acknowledge that you are at least 18 years of age or that you belong to a group that is managed by an administrator who is at least 18 years of age. Members under the age of 18 using the PHR must belong to a group that is managed by an administrator who is at least 18 years of age.
MEMBERSHIP FEE
Members must pay an annual subscription fee by credit card (Visa or MasterCard) to use the PHR. LAXOR publishes the annual subscription fee on its Public Website. LAXOR reserves the right to change the annual subscription fee at its sole discretion.
Members will be notified of the current PHR annual fee 30-days prior to the end of each annual anniversary date. A Member’s subscription will automatically renew and their credit card will be charged for the fee indicated in the notification unless Member declines acceptance of the renewal during the 30-days notification period.
SPONSORSHIP
Some Members may be sponsored by a sponsoring organization or entity that that pays your annual subscription fee. These organizations have a sponsorship agreement with LAXOR. It is your responsibility to ensure that your membership fee is paid regardless of whether or not you are covered by a sponsoring organization. Therefore, we will request that you provide your credit card information when you register whether you are being sponsored or not.
TERMINATION
Members or their legal representatives may terminate the use of the PHR for any reason whatsoever at any time. Termination will be effective thirty days following the date of receipt of a Member’s notice of termination. A pro-rated refund will be made to the credit card used to pay the annual subscription fee.
Upon termination, a Member shall have a 30-day grace period from the date of termination to access their PHR during which time said Member is urged to create a PDF copy of their PHR. After the 30-day grace period, access to said Member’s PHR will be terminated. LAXOR will apply the terms of this paragraph to those Members who have been terminated for any reason except termination for cause.
LAXOR will continue to securely store all terminated Member’s PHR information indefinitely.
LAXOR reserves the right to terminate any Member’s use of the PHR for any reason provided that LAXOR will provide the Member with a 30-day advance notification of LAXOR’s intent to terminate said Member’s use of the PHR, unless said termination is being done for cause. Any termination for cause may occur immediately at LAXOR sole discretion.
Apart from the obligations described here, LAXOR has no other obligations to Members whose use of the PHR has been terminated either by the Member or by LAXOR.
MEMBERSHIP RE-ACTIVATION AFTER TERMINATION
Any Member whose use of the PHR was terminated, with the exception of those Members whose use of the PHR was terminated for cause, can renew his or her use of their PHR by contacting LAXOR and by paying the then applicable annual fee.
Membership cards
LAXOR membership cards are use by LAXOR Members only and remain the property of LAXOR, Inc. They may be modified, revoked and recalled at any time at LAXOR’s sole discretion.
USES OF INFORMATION
LAXOR may, from time-to-time, provide de-identified health information to third parties for which LAXOR may receive a fee. De-identified health information is information from which anything that could personally identify a LAXOR Member has been removed.
When so required, LAXOR will cooperate with duly authorized law enforcement officials and courts of competent jurisdiction. LAXOR may or may not be able to provide you with notice that LAXOR has been required to release your health information to duly authorized law enforcement officials or courts of competent jurisdiction.
